1. INTRODUCTION

Our registered app users (“Members”) share their professional identities, engage with their prospects and customers to exchange knowledge and professional insights, as well as share business and services opportunities. Content and data on the Members’ public profile webpage (“Profile”) is viewable to non-members (“Visitors”). 

When you use the Cloop app or Profile, certain of your Personal Information (defined below) will be collected and processed by us. 

This Privacy Policy explains the when, how and why when it comes to processing of Members’ Personal Information in connection with Cloop, and sets out your choices and rights in relation to that Personal Information. 

By using Cloop you agree to the processing of your Personal Information in accordance with this Privacy Policy. If you do not agree to the processing of your Personal Information in the way this Privacy Policy describes, please do not provide your Personal Information when requested and stop using Cloop. 

Services

This Privacy Policy, including our Cookie Policy, applies to your use of our Services. 

This Privacy Policy applies to Cloop.app and other Cloop-related sites, Apps, communications and services (“Services”), and “Share” plugins. 

Data Controllers and Contracting Parties

Cloop.app will be the controller of your personal data provided to, or collected by or for, or processed in connection with, our Services. 

As a Visitor or Member of our Services, the collection, use and sharing of your personal data is subject to this Privacy Policy and other documents referenced in this Privacy Policy, as well as updates. 

2. SCOPE AND APPLICATION

This Privacy Policy applies to you if you are a Member or a Visitor. 

If you are using Cloop on behalf of a company, partnership, association, government or other organisation (your "Organisation"), you agree to notify such persons in your Organisation whose Personal Information (defined below) we collect or you provide to us ("Connected Persons"), and you agree to obtain such Connected Persons' consent to the processing of their Personal Information in accordance with this Privacy Policy as required by applicable laws and regulations. When this Privacy Policy refers to "you"or "your", this includes you and any Connected Persons. If you or any Connected Persons would like to request for your Personal Information to be removed from our database, please contact us at admin@cloop.app . 

3. DATA WE COLLECT

3.1. Data You Provide To Us

You provide data to create an account with us.

3.1.1. Registration

To create an account you need to provide data including your user name and unique user identifier (user-id). 

3.1.2. Profile

To create your Profile (a complete profile helps you get the most from our Services). 

  • You have choices about the information you put on your profile, such as your Job Position, Profile Description, Profile Photo, Name and Contact Information. You don’t have to provide additional information on your profile; however, profile information helps you to get more from our Services, including helping Visitors and business opportunities find you. It’s your choice whether to include sensitive information on your profile and to make that sensitive information public. Please do not post or add personal data to your profile that you would not want to be publicly available. 

3.1.3. Service Posting and Uploading

  • We collect personal data from you when you provide, post or upload it to our Services e.g. Services, your inspiration content. 

  • You don’t have to post or upload personal data; though if you don’t, it may limit your ability to grow and engage with your network over our Services. 

3.2. Data From Others

3.2.1. Inspiration News

  • You may post content that includes information about you (as part of articles, posts, comments, videos) on our Services. We also may collect public information about you, such as professional-related news and your inspirations, and make it available as part of our Services. 

 

3.3. Service Use

We log your visits and use of our Services, including mobile apps. 

  • We log usage data when you visit or otherwise use our Services, including our sites, app and platform technology, such as when you view or click on content (e.g., inspiration news) or ads (on or off our sites and apps), perform a search, install or update one of our mobile apps, share inspirations or services. We use log-ins, cookies, device information and internet protocol (“IP”) addresses to identify you and log your use.

We collect data through cookies and similar technologies. 

  • We use cookies and similar technologies (e.g., pixels and ad tags) to collect data (e.g., device IDs) to recognize you and your device(s) on, off and across different services and devices where you have engaged with our Services.

We receive data through cookies and similar technologies 

  • When you visit or leave our Services (including some plugins and our cookies or similar technology on the sites of others), we receive the URL of both the site you came from and the one you go to and the time of your visit. We also get information about your network and device (e.g., IP address, proxy server, operating system, web browser and add-ons, device identifier and features, cookie IDs and/or ISP, or your mobile carrier). If you use our Services from a mobile device, that device will send us data about your location based on your phone settings. We will ask you to opt-in before we use GPS or other tools to identify your precise location.

If you and Visitors communicate through our Services, we learn about that. 

  • We collect information about you when you send, receive, or engage with messages in connection with our Services. For example, if you get a chat request, we track whether you have acted on it and may send you reminders. We also use automatic scanning technology on messages to support and protect our site. For example, we use this technology to suggest possible responses to messages and to manage or block content that violates our User Agreement or Professional Community Policies from our Services. 

  • Visitors may communicate or write to you via the Chat function on your Profile. 

 

3.7 Workplace and School Provided Information 

When your organisation (e.g., employer) buys a premium Service for you to use, they give us data about you. 

  • Others buying our Services for your use, such as your employer, provide us with personal data about you and your eligibility to use the Services that they purchase for use by their workers..

We are improving our Services, which means we may get new data and create new ways to use data. If we collect materially different personal data or materially change how we collect, use or share your data, we will notify you and may also modify this Privacy Policy. 

 

4. HOW DO WE USE YOUR INFORMATION?

We keep most of your personal data for as long as your account is open. 

We generally retain your personal data as long as you keep your account open or as needed to provide you Services. This includes data you or others provided to us and data generated or inferred from your use of our Services. 

Aggregated registration data (which does not contain Personal Information) is retained for spam prevention and system security purposes. 

We may also pseudonymize or aggregate Personal Information for analytical purposes. This helps us develop new and improve existing services, conduct fraud detection and account safety analysis and analyse usage trends. 

 

4.1 SENSITIVE PERSONAL INFORMATION

Cloop does not require you to provide sensitive Personal Information to use the service. By posting or communicating any sensitive Personal Information within Cloop, you consent to such information being available within the privacy controls you have selected. 

 

4.2 SHARED INFORMATION

You can control which Shared Information is made public. After you delete Shared Information, it may still be separately cached, copied, or stored by, or remain public through, other users or third parties who are not affiliated with and not controlled by us. Please consider carefully what you post and communicate through Cloop. 

 

4.3 PERSONAL INFORMATION WITHIN YOUR CONTENT 

If any of your Personal Information comprises Your Content (as defined in the Cloop Terms of Service), we and our affiliate companies may (subject to this Privacy Policy) use such Personal Information in accordance with the "Your Content" section of the Cloop Terms of Service. Your Content will be processed to ensure compliance with the Cloop Terms of Service and Acceptable Use Policy. 

 
5. WHO DO WE SHARE YOUR DATA WITH?

We will not transfer your Personal Information to third parties except as specified below, or where you consent to such transfer. 

Only where necessary will we share your information with selected recipients, including: 

  • related group companies. We share your Personal Information within our group of companies, and these related group companies may only use your Personal Information in accordance with this Privacy Policy. 

  • service providers. We engage service providers to supply services to support or improve Cloop. These include SMS and verification, translation, location and mapping, customer service, and content delivery service providers. These service providers are required to provide the same or equal protection of user data as stated in this Privacy Policy and are prohibited from retaining, using, or disclosing your information except as necessary to provide services to us; 

  • we may receive information about you from such third party services and/or share your information with such third party services when you: 

    • log in to Cloop using third party authentication services; 

    • share content from Cloop to third party services;

    • share content on Cloop from third party services;


    third party services may collect information (including personal information and log data), and set cookies on your device. This Privacy Policy only applies to information collected by us, and does not apply to information collected by third parties. 

  • advertising partners. We may share with our advertising partners reports about trends and the performance of their advertisements to help them better understand their audience. We do not share information that personally identifies you, such as name or email address, unless you give us permission to do so; 

  • third parties or related group companies in the event of a merger, acquisition, restructuring, or sale of assets, or by operation of law or otherwise, we will transfer your information to such entity accordingly so that your service can continue. Under these circumstances, we will always require the third parties or related group companies to comply with this Privacy Policy; 

  • government, public, regulatory, judicial and law enforcement bodies or authorities. There are circumstances in which we are legally required to disclose your information, including (i) to comply with a legal obligation or request, such as a court order, subpoena or other legal process, (ii) to enforce our terms, (iii) to address issues relating to security or fraud, or (iv) where there is an imminent emergency involving risk of death, serious physical injury to a person or any risk of harm to a child, and in both cases, provided that the requesting entity has valid jurisdiction to obtain your Personal Information. 

 

6. WHERE DO WE PROCESS YOUR DATA?

Cloop is a global platform. Our engineering, technical, and other support teams are based in Hong Kong and Zhuhai, China, and may have incidental access to certain of your information, for example, in order to fix technical issues that you report. The Personal Information that we collect from you will be stored at, or processed in Singapore.

7. SECURITY OF YOUR PERSONAL INFORMATION

We are committed to maintaining the privacy and integrity of your Personal Information no matter where it is stored or accessed. We protect your Personal Information through the use of information security and access policies that limit unauthorised access to our systems, and technological protection measures such as encryption that ensure confidentiality of your Personal Information during transmission and in storage. 

Although we will implement and maintain reasonable measures to protect your Personal Information, please note that as any transmission of information via the internet is never completely secure. 

8. ADVERTISING

You may choose to stop receiving personalised advertising from us by contacting us at admin@cloop.app.

 

9. COMMUNICATIONS FROM US

We may send you service-related announcements via Cloop, email, or SMS when necessary, such as when we temporarily suspend Cloop for maintenance, or security, or privacy reasons. You may not opt-out from these service-related announcements which are not promotional in nature. 

 
10. AGE RESTRICTIONS AND PARENTAL/GUARDIAN CONTROLS 

Children under the age of 16 (or such applicable age of majority under relevant local laws of the user) ("Child") must not use Cloop for any purpose without first obtaining parental/guardian consent to and acknowledgment of this Privacy Policy (both for themselves and on their Child's behalf). Please contact us if you believe we have any Personal Information from any Child without such parental/guardian consent and acknowledgment so that we can promptly investigate and remove such Personal Information. 

 
11. YOUR RIGHTS

You can access and correct your Personal Information by logging into your Cloop account at any time. 

If you want us to correct your Personal Information that you are unable to correct using your account, please contact us via admin@cloop.app. 

11.1 Erasure

If there is any other Personal Information you believe we process that you would like us to erase, please contact us. 

We may retain the Personal Information if there are valid legal grounds for us to do so (e.g., for the defence of legal claims, freedom of expression or some other legal obligation) but we will let you know if that is the case. 

 
12. CHANGES TO THIS PRIVACY POLICY

We may from time to time revise this Privacy Policy. We will update the revised version here along with the "last updated" date, and notify you via Cloop or other means, as appropriate, before the change becomes effective. 

 
13. LANGUAGE

We have provided translations of this Privacy Policy, but in the event of any conflict between the local language version and the English version, unless otherwise prescribed by applicable laws, the English version shall prevail.
